1. Introduction and Acceptance of Terms

Welcome to Shooo ("Company," "we," "us," "our," or "Shooo"). These Terms of Service ("Terms," "Agreement," or "ToS") govern your access to and use of our website located at shooo.in (the "Site"), mobile applications, and all related products and services provided by Shooo (collectively, the "Services").

By accessing, browsing, or using the Shooo website, mobile app, or purchasing any products from us, you acknowledge that you have read, understood, and agree to be bound by all provisions of these Terms of Service. If you do not agree with any part of these Terms, you must immediately discontinue your use of our Services.

We reserve the right to modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms. Please review these Terms periodically for updates.

2. Eligibility and Account Registration

2.1 Eligibility

By using Shooo Services, you represent and warrant that:

You are at least 18 years of age (or the age of majority in your jurisdiction)
You have the legal capacity to enter into a binding agreement
You are not a resident of any country or region that is under government embargo or on any government list of prohibited or restricted parties
You have not been previously suspended or banned from using Shooo Services
You will comply with all applicable laws, rules, and regulations in your jurisdiction

We reserve the right to refuse service to anyone for any reason at any time.

2.2 Account Registration and Credentials

To access certain features of our Services, you may need to create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain the confidentiality of your account password
Accept responsibility for all activities that occur under your account
Immediately notify us of any unauthorized use of your account or any breach of security
Not share your account credentials with any third party
Not use anyone else's account without permission

Shooo is not responsible for any loss or damage arising from your failure to maintain confidential account information. You are solely responsible for protecting your password and account.

2.3 Account Termination

We reserve the right to suspend or terminate your account immediately without notice or liability if:

You violate these Terms of Service
You engage in fraudulent or illegal activity
You harass or abuse other users or Shooo staff
You attempt to gain unauthorized access to our systems
You violate our return policy or attempt to exploit our refund system

Upon termination, your right to use the Services will cease immediately, and we may delete your account and all associated data.

3. Products and Services

3.1 Product Information

Shooo offers three ultrasonic pest repeller devices:

Buzz Block – Indoor mosquito repeller (₹1,599)
Rodent Block – Cordless rat and mouse repeller (₹3,599)
Perch Block – Solar ultrasonic pigeon repeller (₹3,999)
Home Bundle – All three devices together (₹8,497)

All product descriptions, specifications, pricing, and availability information on shooo.in are subject to change without notice. We strive for accuracy but do not warrant that descriptions, pricing, or other content is accurate, complete, or error-free.

3.2 Product Warranties

All Shooo products come with a 6-month replacement warranty for manufacturing defects only, effective from the date of purchase. For detailed warranty terms, please refer to our Returns & Refund Policy.

3.3 Shooo Money Back Promise

For prepaid orders only, Shooo offers a Money Back Promise in case of:

Non-delivery beyond the promised delivery timeframe
Delivery of damaged products in non-functional condition

This does not apply to Cash on Delivery (COD) orders or orders where the customer has already extensively used the product. For complete details, refer to our Returns & Refund Policy.

3.4 No Returns or Refunds After Order Placement

Once your order is placed and confirmed, returns and refunds are not permitted. By placing an order, you acknowledge that you have reviewed all product information and accept the product as-is.

4. Pricing, Payment, and Billing

4.1 Pricing

All prices displayed on shooo.in are in Indian Rupees (INR) and include applicable taxes unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders already placed.

We reserve the right to refuse or cancel any order, and to correct any pricing errors or omissions on our Site or in our communications.

4.2 Payment Methods

We accept payment through:

Credit cards (Visa, Mastercard, American Express)
Debit cards
Net banking
UPI (Google Pay, PhonePe, Paytm, etc.)
Digital wallets (Apple Pay, Samsung Pay, etc.)
Cash on Delivery (COD) where available
Other payment methods as made available

All payments are processed through secure payment gateways including GoKwik, Razorpay, PayU, and other PCI-DSS compliant processors. We do not store your full payment card details on our servers.

4.3 Payment Frauds and Disputes

You represent and warrant that:

You are authorized to use the payment method you provide
The payment method is valid, accurate, and not fraudulent
You will not use stolen, counterfeit, or unauthorized payment methods
The transaction details are accurate

If we detect fraudulent activity, we may cancel your order, suspend your account, and refer the matter to law enforcement. You are liable for all charges and fees associated with fraudulent transactions.

4.4 Billing and Invoices

An invoice will be sent to your registered email address upon successful payment. You are responsible for ensuring your contact information is accurate. If you do not receive an invoice, please contact us immediately at hi@shooo.in.

4.5 Refunds and Chargebacks

Refunds are only issued under the conditions specified in our Returns & Refund Policy. If you initiate a chargeback or dispute without first attempting to resolve the issue with our customer support team, we reserve the right to:

Refuse future orders from you
Suspend or terminate your account
Report the chargeback to payment processors and law enforcement as appropriate

5. Shipping and Delivery

5.1 Shipping Address

You are responsible for providing an accurate and complete shipping address. We are not responsible for orders delivered to incorrect addresses provided by you. If an order is returned to us due to an incomplete or incorrect address, you may be charged for reshipping.

5.2 Delivery Timeline

We aim to deliver all orders within 5-7 business days across India. Delivery timelines are estimates and not guaranteed. Factors beyond our control (weather, natural disasters, logistics delays, etc.) may affect delivery.

5.3 Shipping Cost

Shipping is free for all orders across India. There are no additional shipping charges.

5.4 Risk of Loss

Once your order is handed over to the courier partner (Shiprocket, Delhivery, or similar), the risk of loss or damage transfers to the logistics provider. However, we remain committed to resolving any delivery-related issues under our Money Back Promise.

5.5 Tracking

You will receive a tracking number via email and SMS. You can track your order in real-time. We are not responsible for delays caused by logistics partners.

5.6 Signature and Delivery Confirmation

Depending on the shipping method, your order may require a signature upon delivery. Please ensure someone is available to receive the package. If delivery is attempted and refused, the order may be returned to us, and you may incur reshipment charges.

6. Prohibited Activities

You agree not to:

Use the Services for any illegal, fraudulent, or unauthorized purpose
Violate any applicable laws, regulations, or third-party rights
Infringe on intellectual property rights, including trademark, copyright, or patent rights
Engage in harassment, abuse, threats, or violence toward any person or entity
Spam, phish, or attempt to gain unauthorized access to our systems
Upload viruses, malware, or any code intended to damage our systems
Scrape, crawl, or use bots to extract data from our Site without permission
Reverse-engineer, decompile, or attempt to discover the source code or internal mechanics of our Services
Attempt to circumvent security measures or access restricted areas
Engage in price manipulation, fraud, or deceptive practices
Create multiple accounts to circumvent our policies
Resell products purchased from Shooo without permission
Use our brand name, logos, or trademarks without written permission
Engage in any activity that disrupts the normal functioning of our Services

Violation of these prohibitions may result in immediate termination of your account and legal action.

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content on shooo.in, including but not limited to text, graphics, logos, images, videos, product designs, and software, is the exclusive property of Shooo or licensed to us by third parties. This content is protected by international copyright, trademark, and other intellectual property laws.

Shooo® and related logos are registered trademarks of Shooo. Buzz Block®, Rodent Block®, and Perch Block® are proprietary product names of Shooo.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Site for personal, non-commercial purposes only. This license does not include:

Downloading or copying content for commercial use
Modifying or creating derivative works
Selling, licensing, or transmitting content
Removing or altering copyright notices or proprietary markings

7.3 User-Generated Content

If you submit reviews, comments, feedback, or other content ("User Content") on our Site, you grant Shooo a worldwide, royalty-free, perpetual license to use, display, modify, and distribute your User Content without compensation or further permission.

You represent and warrant that your User Content:

Does not infringe on any third-party rights
Is not defamatory, obscene, or otherwise unlawful
You own or have permission to share the content
You waive any moral rights associated with the content

We may moderate, remove, or refuse to publish User Content at our sole discretion without notice or liability.

8. Liability and Disclaimers

8.1 Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, SHOOO PROVIDES OUR SERVICES ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Services will be uninterrupted, timely, secure, or error-free
Warranties that defects will be corrected
Warranties regarding the accuracy, completeness, or reliability of content

We do not warrant that the Services will meet your requirements or expectations, that access will be continuous or uninterrupted, or that errors will be corrected.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHOOO, ITS FOUNDERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCTS PURCHASED, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE.

This limitation applies regardless of the form of action (contract, tort, strict liability, or otherwise), even if Shooo has been advised of the possibility of such damages.

Our total liability to you shall not exceed the amount you paid for your order in the 12 months preceding your claim.

8.3 Jurisdiction-Specific Limitations

Some jurisdictions do not permit the exclusion or limitation of certain warranties or liability. To the extent required by law, we do not disclaim warranties that cannot legally be disclaimed, and our liability is limited only to the extent permitted by law.

8.4 Product Safety and Usage

You acknowledge that pest repeller devices:

Do not kill pests; they deter or repel them
Results vary based on environmental factors, pest species, infestation severity, and proper setup
Require continuous operation for effectiveness
Are not a substitute for professional pest control services in severe infestations

Shooo is not liable for failure of products to achieve desired results, pest-related damages or losses, or any consequences arising from pest-related issues.

9. Indemnification

You agree to indemnify, defend, and hold harmless Shooo, its founders, officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of or access to the Services
Your violation of these Terms
Your violation of any law, regulation, or third-party right
User Content you submit or transmit
Your conduct or actions on our Site

We reserve the right to take over the exclusive defense of any claim, and you agree to cooperate fully with us in such defense.

10. Third-Party Links and Content

Our Site may contain links to third-party websites, applications, and services. We are not responsible for the content, accuracy, reliability, or practices of these third-party sites. Your access to and use of third-party sites is at your own risk and subject to their terms of service and privacy policies.

11. User Conduct and Community Standards

We expect all users to communicate respectfully. You agree not to:

Post defamatory, obscene, or offensive content
Make threats or engage in harassment
Discriminate based on protected characteristics
Spam or flood the platform with repetitive content
Engage in cyberbullying or toxic behavior

11.2 Review and Feedback Standards

When submitting reviews or feedback:

Be honest and provide genuine opinions based on actual product use
Provide relevant information that helps other customers make informed decisions
Do not submit false, misleading, or fraudulent reviews
Do not pay for positive reviews or pay others to post negative reviews
Do not use reviews for competitive sabotage or self-promotion

We may remove reviews that violate these standards without notice. Repeated violations may result in account suspension.

12. Dispute Resolution

Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally. Contact us at hi@shooo.in with a detailed description of the dispute, and we will attempt resolution within 15 days.

12.2 Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Kanpur, Uttar Pradesh, India.

12.3 Arbitration (Optional)

For disputes that cannot be resolved informally, both parties agree to submit the matter to binding arbitration under the Arbitration and Conciliation Act, 1996, rather than litigation. The arbitration will be conducted in English by a single arbitrator in Kanpur, Uttar Pradesh, India.

12.4 Class Action Waiver

You agree not to bring claims against Shooo on a class action, class arbitration, or representative basis. All claims must be brought in your individual capacity.

13. Changes to Terms of Service

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms.

If you do not agree to any changes, you must stop using the Services immediately.

We recommend reviewing these Terms periodically to stay informed of updates.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and Returns & Refund Policy, constitute the entire agreement between you and Shooo regarding your use of our Services. They supersede all prior discussions, agreements, and understandings.

If any conflict exists between these Terms and other policies on our Site, these Terms take precedence unless explicitly stated otherwise.

17. Prohibited Jurisdictions

Shooo Services are not available in the following:

Countries under government embargo (U.S. sanctions list)
Territories with restricted access due to local regulations
Any location where offering our Services would violate local law

If you access our Site from a restricted jurisdiction, you do so at your own risk, and you are solely responsible for ensuring compliance with local laws.

18. Force Majeure

Shooo shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from causes beyond our reasonable control, including but not limited to:

Natural disasters, earthquakes, floods, or severe weather
War, terrorism, civil unrest, or government action
Pandemics or epidemics
Strikes, lockouts, or labor disputes
Failure of utilities or telecommunications infrastructure
Acts of God

In such cases, we will make reasonable efforts to resume performance as soon as practicable.

19. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by Shooo. Failure to enforce any right or provision does not constitute a waiver of that right or provision.

20. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without Shooo's prior written consent. Any attempted assignment is void. Shooo may assign these Terms to its successors, affiliates, or in connection with a merger or acquisition.

21. Notices

All notices under these Terms shall be in writing and deemed delivered when:
